The lawsuit comes after Trump banned the three national news outlets from the White House, citing what he claimed was unfair coverage. The news organizations assert that the ban constitutes viewpoint discrimination and violates their First Amendment rights, arguing that the government should not dictate what the press reports or publishes.
The lawsuit, filed in the DC District Court, seeks an immediate injunction to block the ban and restore the press credentials and access for the affected journalists. Reporters from these outlets had their badges confiscated and were denied entry to the White House on Saturday. The news organizations argue that the ban not only impedes their ability to gather news at the seat of the Executive Branch but also impermissibly chills the speech of other news organizations, who might fear similar retaliation for critical reporting.
Beyond First Amendment violations, the lawsuit also alleges a breach of the Fifth Amendment's due process clause. The plaintiffs claim that the Trump administration provided neither advance notice nor an opportunity for the media organizations to be heard before imposing the ban. This lack of due process, coupled with the alleged retaliation for past news coverage, is central to their legal challenge. Industry experts, like Bruce Brown, President of the Reporters Committee for Freedom of the Press, have characterized the ban as "flatly unconstitutional" and a clear example of viewpoint discrimination.
