Former Republican congressman George Santos has been permanently banned from the prediction market platform Kalshi following a ruling by the Commodity Futures Trading Commission (CFTC). The CFTC ordered Santos to pay a total of $35,000, consisting of a $17,500 civil monetary penalty and the disgorgement of over $17,500 in profits he made from the trades. The agency also imposed a three-year ban on Santos from trading in prediction markets. Kalshi had previously reported Santos's suspicious activities to regulators and announced its intention to pursue its own enforcement action, with a commitment to reimburse affected traders if monetary penalties are recovered.
Santos's trades involved event contracts on Kalshi concerning whether he would attend the State of the Union address. He posted on social media about his plans to attend, then later claimed he was unable to make it due to travel issues, all while allegedly manipulating the market in his favor. The CFTC stated that Santos made "material misrepresentations and omissions" in his social media posts, which caused contract prices to move favorably for his positions, allowing him to profit by more than $17,500.
While Santos agreed to the settlement, his lawyer, Joseph Murray, stated that Santos did so without admitting any wrongdoing. Murray emphasized that the settlement was a practical resolution to avoid protracted litigation and that Santos had a "genuine intention" to attend the State of the Union, with a winter storm disrupting his plans. Kalshi CEO Tarek Mansour confirmed that their system flagged Santos's attempt to manipulate a market within seconds, leading to an investigation and numerous whistleblower complaints.
This incident follows Santos's previous legal troubles, including an 87-month sentence for wire fraud and aggravated identity theft, which was commuted by President Donald Trump. Prediction markets and regulators are under increased scrutiny to prevent insider trading, particularly by public officials, highlighting the significance of this enforcement action.
