UN Human Rights Chief Volker Türk expressed serious concern over reports of arrests and detentions of opposition members in Zambia both before and after the August 13 general election. He called on the authorities to immediately cease arbitrary arrests and ensure the full upholding of due process rights for all individuals currently detained.
Türk emphasized that all arrests and subsequent legal proceedings, regardless of the alleged conduct or specific charges, must strictly comply with international human rights standards and Zambian domestic law. He specifically highlighted that detainees must be informed of the reasons for their arrest and any charges against them, be granted access to legal representation and communication with their families, be treated humanely in custody, and be brought promptly before a judge.
Main opposition leader Brian Mundubile, who garnered approximately 38% of the vote against President Hakainde Hichilema's 60%, claimed to be in a secure location due to safety concerns. He denied government allegations that he was present at a property where "high-grade military weapons" were found and 11 opposition officials were arrested for allegedly posing a threat to state security. Mundubile stated that the opposition officials were unarmed and were shot at by security forces during a raid. The government, however, claimed an exchange of gunfire occurred during the raid.
International election observers, including the European Union, echoed concerns about intimidation and restrictions that marred the opposition's campaign. Türk underscored the critical importance of respecting human rights at this post-election juncture and ensuring that any grievances related to the election are addressed peacefully and in accordance with international human rights law. The UN's intervention follows a turbulent period surrounding the election, despite the electoral commission declaring the vote largely peaceful.
The arrests include several figures from the main opposition alliance, detained last week on rejected allegations of involvement in militia activities. The UN's call for adherence to due process also includes providing detainees with access to effective remedies for any violations of their rights, highlighting the need for transparency and fairness in the legal process.
